DMCA Policy

Accessorbit respects the intellectual property rights of others and expects users of its services to do the same. This Digital Millennium Copyright Act Policy ("Policy") describes how Accessorbit responds to notices of alleged copyright infringement and how rights holders may submit a valid takedown request.


1. Overview

In accordance with the Digital Millennium Copyright Act ("DMCA") and other applicable intellectual property laws, Accessorbit will respond expeditiously to claims of copyright infringement that are reported to its designated copyright agent. Accessorbit reserves the right to remove or disable access to content alleged to be infringing and, where appropriate, to terminate the accounts of users who are found to be repeat infringers.

2. Reporting Copyright Infringement

If you believe that content available through Accessorbit infringes one or more of your copyrights, you may submit a written notification to our designated copyright agent. To be effective under the DMCA, your notification must include all of the following:

  1. A physical or electronic signature of the person authorised to act on behalf of the copyright owner.
  2. Identification of the copyrighted work you claim has been infringed. If multiple works are covered by a single notification, a representative list of such works is sufficient.
  3. Identification of the material that is claimed to be infringing or to be the subject of infringing activity, and information reasonably sufficient to permit Accessorbit to locate the material (such as a URL or specific page description).
  4. Your contact information, including your name, mailing address, telephone number, and email address.
  5. A statement that you have a good-faith belief that use of the material in the manner complained of is not authorised by the copyright owner, its agent, or the law.
  6. A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorised to act on behalf of the copyright owner.

4. Counter-Notification

If you believe that content you posted was removed or disabled as a result of a mistake or misidentification, you may submit a counter-notification. To be effective, your counter-notification must include all of the following:

  1. Your physical or electronic signature.
  2. Identification of the material that has been removed or to which access has been disabled, and the location at which the material appeared before it was removed or access was disabled.
  3. A statement under penalty of perjury that you have a good-faith belief that the material was removed or disabled as a result of mistake or misidentification.
  4. Your name, mailing address, and telephone number, and a statement that you consent to the jurisdiction of a competent court in the territory where you are located, and that you will accept service of process from the person who provided the original notification or an agent of that person.

Upon receipt of a valid counter-notification, Accessorbit may restore the removed content, unless the original complainant files a court action seeking to restrain the alleged infringing activity within the period required by applicable law.


5. Repeat Infringers

Accessorbit maintains a policy of terminating, in appropriate circumstances, the accounts of users who are determined to be repeat infringers. A repeat infringer is any user who has been the subject of two or more valid DMCA takedown notices.

6. False Notifications

Knowingly submitting a materially false claim of copyright infringement or a materially false counter-notification may result in civil liability. Before submitting any notification or counter-notification, you should consult a qualified legal adviser to understand your rights and obligations.

7. Modifications to This Policy

Accessorbit reserves the right to modify this Policy at any time. Changes will be effective upon posting of the revised Policy on the website. Continued use of Accessorbit services after any such changes constitutes acceptance of the modified Policy.
